Unfortunately, OMB Circular A-16 applies only to federal geographic
data, not to geographic data collected by the states (e.g., California).

I would think that OMB Circular A-16 sets the policy for open data
access. Anything paid for with public funds is in the public domain
subject to distribution or copying fees.
